1. Acceptance of Terms
By installing, accessing, or using the Data Quality Manager application ("the App") from the Databricks Marketplace, you ("Consumer" or "you") agree to be bound by these Terms of Service ("Terms"). If you are accepting on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not install or use the App.
These Terms constitute a legal agreement between you and Plainsight BV, a company incorporated under Belgian law with registered office at Brusselsesteenweg 6, bus 101, 9050 Gent, Belgium ("Plainsight", "we", "us", or "our").
2. Description of the App
The Data Quality Manager is a browser-based data quality management application ("App") that runs entirely within your Databricks workspace as a Databricks App. The App enables data teams to:
• Define, manage, and run data quality validation rules (Expectations) using a data quality validation framework; • Validate data directly against Unity Catalog tables in your workspace; • Monitor validation results via a results dashboard with pass/fail trends; • Browse Unity Catalog metadata including tables, schemas, and column definitions; • Receive failure notifications via Microsoft Teams webhooks or SMTP email.
The App is distributed through the Databricks Marketplace and runs exclusively in the Consumer's own Databricks workspace environment. Plainsight does not host, operate, or have access to any instance of the App deployed by the Consumer.
3. License Grant
Subject to these Terms and your compliance with them, Plainsight grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
(a) Install and use the App within your organisation's Databricks workspace(s) solely for your internal data quality management purposes;
(b) Make copies of the App source code solely as necessary for backup or archival purposes;
(c) Modify the App's configuration files (such as app.yaml and assets/brand.yaml) for the purpose of customising the deployment to your environment.
This license does not grant you the right to:
• Resell, redistribute, sublicense, or otherwise make the App available to third parties outside your organisation; • Remove or alter any proprietary notices, labels, or marks on the App; • Use the App to build a competing product or service; • Reverse engineer the App beyond what is permitted by applicable law.
4. Data and Privacy
4.1 In-Workspace Operation. The App runs entirely within the Consumer's Databricks workspace. All data processed by the App — including Unity Catalog table data, expectation suite definitions, and validation results — is stored in the Consumer's own Unity Catalog (as Delta tables in the dataquality schema) and never transmitted to Plainsight or any third party controlled by Plainsight.
4.2 No Data Collection by Plainsight. Plainsight does not collect, process, or have access to any personal data or business data from your Databricks workspace through the App. The App does not include any telemetry, tracking, or analytics that transmits data to Plainsight.
4.3 Notification Integrations. If you configure optional notification integrations (Microsoft Teams or SMTP email), data about validation failures — including suite names and failure summaries — is transmitted to the endpoints you configure. You are responsible for ensuring such transmissions comply with your organisation's data handling policies.
4.4 Consumer Responsibility. You are solely responsible for ensuring that your use of the App, and any data it processes, complies with applicable data protection laws (including but not limited to GDPR where applicable), your organisation's internal policies, and any obligations you have to data subjects.

5. Consumer Obligations
As a Consumer of the App, you agree to:
(a) Use the App only for lawful purposes and in accordance with these Terms;
(b) Ensure that your Databricks workspace meets the prerequisites described in the documentation before deploying the App;
(c) Maintain appropriate security controls over access to the App and any Unity Catalog schemas, Delta tables, or Databricks Jobs associated with it;
(d) Not use the App to validate or process data for which you do not have appropriate authorisation;
(e) Comply with all applicable Databricks Marketplace Consumer policies as updated from time to time;
(f) Not use the App in any way that could damage, disable, overburden, or impair Databricks infrastructure or Unity Catalog services.
6. Provider Obligations
Plainsight, as the provider of this listing in the Databricks Marketplace, commits to:
(a) Maintaining accurate and up-to-date descriptions of the App in the Marketplace listing;
(b) Providing at least 30 days' notice before delisting or materially changing the App in a way that would break existing deployments;
(c) Handling any personal data shared by Consumers in the context of support requests in accordance with our Privacy Policy;
(d) Complying with all applicable Databricks Marketplace provider policies.
7. Intellectual Property
7.1 App Ownership. The App, including all source code, documentation, and associated materials, is the intellectual property of Plainsight BV and its licensors. These Terms do not transfer any ownership rights to you.
7.2 Third-Party Components. The App incorporates third-party open-source software, including a data quality validation library (Apache License 2.0), Dash by Plotly (MIT License), and Databricks SDK (Apache License 2.0). Your use of those components is subject to their respective licenses.
7.3 Feedback. If you provide Plainsight with any feedback or suggestions regarding the App, you grant Plainsight a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLAINSIGHT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; • THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS; • THAT THE RESULTS OBTAINED FROM USING THE APP WILL BE ACCURATE OR RELIABLE; • THAT THE APP WILL BE COMPATIBLE WITH ALL VERSIONS OF DATABRICKS RUNTIME OR THIRD-PARTY COMPONENTS.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PLAINSIGHT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY:
• INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES; • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL; • COST OF SUBSTITUTE GOODS OR SERVICES;
ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF PLAINSIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT PLAINSIGHT'S LIABILITY CANNOT BE EXCLUDED, PLAINSIGHT'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED EUR 100.
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
10. Term and Termination
10.1 These Terms are effective from the date you first install or access the App and continue until terminated.
10.2 You may terminate these Terms at any time by uninstalling and ceasing all use of the App from your Databricks workspace.
10.3 Plainsight may terminate these Terms or suspend your access to the App immediately if you materially breach any provision of these Terms and fail to cure such breach within 14 days of receiving written notice.
10.4 Plainsight may delist the App from the Databricks Marketplace at any time, such that new Consumers cannot discover or install the listing. Plainsight will provide at least 30 days' notice before doing so, except where required by law or to protect the integrity of the Databricks platform.
10.5 Upon termination, the license granted in Section 3 will immediately cease. Sections 4, 7, 8, 9, 11, and 12 survive termination.
11. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any disputes regarding their existence, validity, or termination, shall be submitted to the exclusive jurisdiction of the courts of Ghent, Belgium, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
12. Changes to These Terms
Plainsight reserves the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required, provide notice through the Databricks Marketplace listing or by other means.
Your continued use of the App after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
